Expert delay and quantum services on behalf of an employer at arbitration
A locally based industrial company entered into a construction contract for the construction of its new facilities in Abu Dhabi comprising a new office building, workshops, logistics building, labour facilities and marine jetty for an amount of about AED 100m in a period of 13 months.
For numerous reasons, the contractor failed to perform and the project became substantially delayed. In addition there were a number of acrimonious arguments about additional work resulting in the contractor refusing to prosecute the Works until the Employer signed-off on significant additional costs. Eventually a deadlock was reached and the Contractor was terminated, following which it commenced arbitration proceedings against the employer for an amount in dispute of about AED 50m.
Upon the recommendation of an international law firm, a director and associate director of the partnership have each been appointed by the employer as Quantum Expert and Delay Expert respectively and the case is currently on-going.
