A dispute in connection with MEP installations on a significant high-rise building in Dubai
A Mechanical Electrical & Plumbing subcontractor was employed by a main contractor under a bespoke sub-contract to carry out the MEP installations on a major Dubai tower.
The project ground to a halt shortly after the 2008 financial crisis when the Employer ran out of funds, leaving the construction in a state of suspension and owing both the main contractor and MEP sub-contractor significant sums of money.
We were appointed by the MEP sub-contractor to carry out an initial review of its entitlement under the Contract and to propose a strategy moving forward.
Subsequently we were instructed to prepare a fully detailed Statement of Claim which included demonstration of entitlement to recovery of additional costs, loss and expense resulting from delays to (and, ultimately, suspension of) the works, as well as delayed payment and non-payment of amounts properly due under the terms of the sub-contract.
The value of the claim is circa AED40m and the case is currently on-going at arbitration.
