Advocacy to a Dispute Adjudication Board (DAB)

A UAE based contractor entered into a contract for the construction of an apartment building in Dubai on the basis of a FIDIC 1987 red-book contract with bespoke particular conditions. 

The contract sum agreed was around AED 50m and the construction period was 15 months.  The contractor claimed to have been delayed by multiple employer driven changes, non-payment of variations and lack of decisions in connection with key matters concerning the specification.  Dispute resolution was by means of arbitration through the DIAC with three arbitrators.  Following a period of amicable settlement the contractor commenced arbitration proceedings against the employer.

Peter Evans was the party appointed arbitrator by the claimant and saw the arbitration through to award.
