Advocacy to a Dispute Adjudication Board (DAB)

An Arabian Gulf based quasi-government waste-water employer entered into a contract with a far-east based infrastructure contractor for the installation of a waste-water distribution network and pumping station in and around a district of its capital city.  The contract period was three years and the value was about US$ 200m.

A number of disputes arose during the course of the works concerning technical issues, measurement, descriptions of work and contract interpretation.  Various Engineer’s Decisions were issued, all of which were disputed by the contractor and then referred to the DAB which was established under the terms of the contract and empowered to issue final and legally binding decisions.

Over a period of 2 years, we prepared defences on behalf of the employer and acted as advocate in front of the DAB, leading to a successful outcome for the employer.
